Oh What A Happy Week!..............Important Blog about Taxes
Well all seems right with the world this week. Yep, the Yankees won the World Series in 6 games. Hideki Matsui walked away with the well deserved MVP award. 6 RBIs in one game. Wow, he sure came though for the Yankees. Congrats to the Joe Girardi and the team from this Abaco lady.
On a more serious note-
We agents in the real estate world have been seeing more and more cases when we sell a house that a lot of sellers are still paying property taxes on vacant property even though they may have built a home on it 10 years before. The sellers have failed to notify the property tax office that they improved their property. Some of them may even feel as if they can get away with this. When you receive a tax bill year after year for VACANT property, somewhere along the line you should realize that 'oh yes, I now have a house on this property and it's no longer vacant land'.
The government is crunching down more and more on these cases and carefully looking at the value on the tax bill that you have been billed for over the last x amount of years versus the sales price.
At one time if someone was in arrears on their taxes the seller's attorney would deducted the amount owed from the net proceeds of the sale. This put a crimp in the final proceeds coming into the sellers pocket, however it was one way to get the bill paid. And convenient if the seller did not have the financial means to pay the back taxes.
Now, the Foreign Investment Board is requiring that taxes are brought up to date BEFORE issuing a permit to a buyer and allowing the sale to move forward. This means that the amount owed for taxes cannot be taken out at the end of the sale but that the property taxes must be satisfied before they will issue the permit. If a seller is not in a financial position to pay the back taxes this will cause the sale to come to a stand still.
To avoid any nasty surprises when it comes time to sell make sure you are paying the taxes you are supposed to be paying and that you are current on your tax bill. Your real estate agent or attorney will be able to point you in the right direction if you are unsure of how to go about this.
Remember this will help you avoid unnecessary delays when selling.

Go Yankees!
Well today, Monday, 2nd November is a happy day. The New York Yankees took Game 4 against the Phillies in the World Series last night. That's 3-1 for the Yanks in this series. One more win tonight for us and it's lights out Phillies!
It was a nice Halloween for the kids on Man-O-War again this year. The kids were out in scary, beautiful, ugly, and funny costumes as usual. All carrying a big bag of candy that they had collected. You've read before where I have blogged that MOW is the best place to be on Halloween if you have kids. It's fun, it's relaxed and most important of all it's safe. Once the little tykes are done then later on in the evening the adult monsters turn out. They're not looking for candy however but rather just simply to give the town a fun show.
Today in Abaco, the weather is nice again. We're still experiencing summer heat and the sea of Abaco was so calm this morning it felt like we should have all just been relaxing on the sea. Made you just want to grab a hand line and go fishing.
These simple features I have just blogged about are what keep people coming back to our shores and what entices them to purchase Abaco real estate. The laid back island lifestyle, the warm temperatures, the crystal clear water and beautiful surroundings are things we should not take for granted. God had blessed us with this environment and we are thankful.

Summer Place REDUCED!
Hi Folks,
Just had a nice long holiday weekend here. I showed property out at Schooner Bay on Saturday and it was a gorgeous day for it. Worked for just a wee bit on Sunday and then relaxed at the 'Low Place', a spot on Man-O-War that is ideal for just wading in the water and capturing the cool breeze. Monday was the actual holiday. It was our Discovery Day. Yes, when Christopher Columbus discovered our islands. So I took advantage of it and got a few things done around the house.

Relaxing on the Sea for the weekend
Yep it's Friday :) This afternoon Grant ( my husband) and I will be heading 'up the cays' as we call it for the weekend. Pigeon season opened on Tuesday and unfortunately Grant only shot 3. So we are heading back to spend 2 nights on a house boat and try our luck again. Also we are looking forward to getting a bit of diving in. We'll look for a few conchs to make a conch salad and hopefully find a few spiny lobsters to throw on the grill!
For those of you have have been to Abaco and have explored by boat you know that the scenery is just simply pristine and peaceful. We will be anchored just off of Lynard Cay and we are set for a relaxing and stress free weekend.

Advantages of pre-qualifing
Everyone out there probably dreams of owning their own home one day. Not everyone has the cash to buy any house on the market. How disappointing it is to search for a home, fall in love with one only to go to the bank and be told that you don't qualify for the amount needed to purchase the house.

Wilson City Power Plant
Happy Friday Folks,
Just wanted to let everyone know that there will be a town meeting next Thursday, 10th Sept at 7:00pm to discuss the new Bahamas Electricity Corporation's power plant at Wilson City. The venue will be held at New Vision Ministries in Marsh Harbour. This is a very important meeting and all who are able to attend should make the effort so that we can educate ourselves on the type of fuel that this plant will use and other facts about the new station.
Minister of Environment, Hon. Earl D. Deveaux and Minister of State, Hon. Phenton O. Neymour will be there!
Well we are having showers of blessings here in Abaco today as the rain has been pouring down for the past 2 hours. It looks as if Tropical Storm Erika is not going to be much of a threat but there is another storm just off of the coast of Africa that the 'weather people' are watching. Let's keep our fingers crossed that all storms steer clear of Abaco this year.
Well it's a holiday weekend for the US, Labour Day, so we are bound to see more people around over the next few days. Some use this time for a quick get away and just to simply relax and others may plan to use the holiday to schedule their trip over to look at Abaco real estate.

A Real Estate Pillar has fallen
Last month one of Abaco's Real Estate greatest passed away after a battle with cancer. Derek Lee (affectionately called Ricky by the MOW residents) of Abaco Cays Realty was a mentor to me and many other real estate agents in the Bahamas but especially Abaco. This great man practiced business with the highest standard of ethics and helped bring our real estate industry into the 21st century. He was one who had a hand in helping to bring the first MLS into existence in the Bahamas. Our Abaco MLS was introduced even before the national MLS that was launched last year.
He helped bring the Abaco Chapter of the Bahamas Real Estate Associtaion to life and served as our first president and stayed on a second term to assist the incoming president. I had the privilege to serve with him.
Ricky lived on the same cay as I do, Man-O-War Cay. He has served on our local boards and was always willing to lend a hand to help out wherever he could. He has provided a Christmas mailing list for years to the community with all of the locals and second home owners addresses and phone numbers. Before he passed away he asked if I will help Chris Albury, one of his agents, with this project starting this year. Of course I will be honored to help not only for the benefit of the community but also in his memory.
I will miss his calls to ask my advice or opinions on a new listing and I will certainly miss his advice. I will always remember his signature greeting, 'What can I do to brighten your day?' That question alone speaks volumes of the type of man Ricky was and even before he passed away I adopted this question as a way to put a smile on someone's face. Because if I can help brighten someone's day then I have done a good deed.
A memorial service will be held in Man-O-War for him however there has not been a date set yet.

Full Ban on Sea Turtles
It is official effective tomorrow, 1st Sept, 2009. The Bahamas Government has placed a full ban on sea turtles. One can not capture them, posses them, or sell any part of them including the eggs.
For the past 12 months the Bahamas Government has engaged in extensive consultations with the Bahamian public over this issue. The Hawksbill Turtle has been protected since 1986 but now the government has made the necessary steps to safeguard all sea turtles.
While some of you may not agree with this new ban please remember it is now illegal to capture ANY turtles even if you are only looking for enough for a meal. We must respect the law.
As you travel our pretty Abaco water's keep an eye out for these beautiful creatures as they surface, and enjoy watching them swim in their natural surroundings.

Ms Universe 2009 held in the Bahamas!
Sunday August 23rd marked an historic day for our country. The Ms. Universe 2009 pageant was held at Atlantis in Nassau, Bahamas. This was a very proud moment for our small country. The eyes of the world were watching!
The contestants arrived weeks before the pageant and was fortunate to have traveled to various parts of our beautiful country to witness the island life. 29 of the contestants visited Abaco and was toured through parts of Treasure Cay and Green Turtle Cay and then on for a fun filled day at Manjack Cay on a beautiful beach. Our very own Krista who works in the office with me was honored to have been asked to escort these ladies around the charming settlement of GreenTurtle. Krista is a Rotarian and several Rotarians were asked to take part.
The videos during the pageant featured beautiful Abaco Real Estate and highlighted our pristine unspoiled beaches along with showing what its like to live the island life. Many people visit our shores years after year to enjoy this lifestyle and eventually decide that they have to own their own little piece of paradise here in Abaco. Many of the contestants were expressing their desire to return to our lovely country.
The pageant made history itself. It was the first time in the pageant's history that the outgoing queen crowned its successor who was from the same country. Stefania Fernadaz, Ms. Venezula, was crown queen of Ms. Universe 2009! Congratulations to her.
The Bahamas will be remembered for hosting the historic event.

Lobster season opens
Hip hip hooray! Yes, Lobster season opened this past Saturday. I was fortunate enough to get to go out in the boat and look for a few tails. My husband of course did the spearing and my 11 year old nephew speared his very fist crawfish that day. We did not find a lot but we did manage to get enough for a meal for our family. Needless to say we enjoyed a very tasty dinner of grilled crawfish!

Happy Independence Day Bahamas!
July 10th marks the Bahamas 36th year of Independence! Tomorrow is the day that will be up held for the holiday. So what's happening you ask? Well in Man-O-War there will be the annual Independence Day races and celebration! People from all over Abaco bring their kids to this much anticipated event. In the morning there are running races, sack races, three legged races, egg and spoon races, disk throwing, and more. In the afternoon the water sports begins also. There are swimming races, diving races, and bobbing for apples. Some of the fun activities for the older folks include, conch breaking contest, wood sawing contest, nailing contest and the oh so much awaited time of the day, the SLIPPERY POLE! That is where a long and huge PVC pipe with wood in the middle is nailed to the dock and extends out over the water. There is a piece of canvas nailed in the center of the wood in the PVC. The guys all take turns sliding on it to the end and trying to pull this off. Of course the first one to get it pulled off is the winner. But wait! It's not just simply one at a time! Just when you think maybe you have it, someone slides out and tries to knock you off of the pole, and into the water you will fall! And the best and most fun part is the pole has been greased in CRISCO! That's right Crisco! Wanna give it a try?
Later on that evening the winners of all of these events will be receive their medals and participants will receive a certificate. And for a beautiful close to the evening a firework display.

Upgrade coming for BEC Abaco?
Budget for BEC's Abaco plant balloons by $20m

The government appears to have revised upward by $20m its budget for a new BEC plant in Abaco, with the minister responsible yesterday confirming the projected price tag stands at $90m.
According to State Minister for Utilities Phenton Neymour, the money would come out of the $211m loan for the Bahamas Electricity Corporation tabled in the House of Assembly last week.
"We're building (the) facility in Abaco for approximately $90m," said Neymour, a guest speaker at the Chamber of Commerce's annual Meet the Ministers forum. "We expect to be finished with that in January."
Also included in the loan funds was a $30m new plant in Hatchet Bay, Eleuthera, as well as a Bimini plant expansion and takeover of Inagua's plant.
Yesterday's announcement of a bump-up in costs for the Abaco plant reflects a $20m difference in price from Neymour's earlier estimations.
As late as February 2009, he told Guardian Business that the government's focus was now on building that $70 million new plant meant to meet the expanding needs of the Abacos, the country's third center of commerce and site of an increasing number of resorts.
He also confirmed the Marubeni group of Tokyo has expressed interest in purchasing BEC's Abaco plant once its replacement was erected, at the same time dismissing reports a sale is, in fact, in the works.
"Marubeni has visited Abaco, to my knowledge, with a team from the (Bahamas Electricity Corporation)," he said then, speaking to source reports that, that company sharing a majority stake in Grand Bahama Power is looking to expand its presence in this market with the acquisition. "As you know, Abaco has had some challenges particularly in 2006/2007 where we had to supplement the current operation significantly, but [a sale of the old plant] has not been determined and has not been confirmed."
Given that Abaco had a growing economy, the island is attractive to power generators looking to grow their business outside of their own home markets. Taking over the existing BEC plant would allow a private entity to win some of the islands' resort business, given developers while keen to establish their own water treatment plants have generally resisted constructing their own power plants. Neymour asserted in an earlier interview that government was seriously considering a review of the original BEC Abaco contract for the plant to make an allowance for private sector participation in the new facility.
"We have had a preliminary view and preliminary look at how private sector participation could assist in improving operations in Abaco at the new plant," said Neymour. "We haven't determined the structure of such an agreement at this time.
"But we feel that it may be in great benefit to BEC to have it reviewed as to whether we can have private sector participation in operating that facility."

BREA's 50th Anniversary
The Bahamas Real Estate Association celebrated it's 50th Anniversary recently. An awards Banquet was held recognizing some of those who have been in the real estate business for a long time. Our very own Anne Albury of Treasure Cay was among the ones who was honored for her hard work and contributions to Abaco real estate industry. Congrats Anne!
The Prime Minister The Right Honorable Hubert A. Ingraham addressed all those in attendance. I have copied his speech below. He spoke mainly about the property taxes and thought you may be interested to see what he had to say.

Ladies and Gentlemen:
I am pleased to join you to mark the 50th anniversary of the establishment of The Bahamas Real Estate Association (BREA). This is a significant landmark in the history of BREA and speaks to the strength and resilience of your association.
Land development, and hence land sales, were central to our national development long before we came to be an independent country. For many years real estate agents and brokers were not regulated.
The need to regulate and manage land sales resulted in the formation of your association. And, it was not until 1995, at the behest of many of your founders, that realtors became a legally regulated profession in The Bahamas.
Similarly, the sale of land to foreigners was not regulated. It was not until the passage of the Immovable Property (Acquisition by Foreign Persons) Act of 1983 (remember that!) that land sales to non- Bahamians became legally regulated. For several years prior the sale of land to foreign persons was controlled by policy as opposed to by law.
A famous French philosopher once said, “The right of property is the most sacred of all rights of citizenship.”
Most Bahamians, I believe, share that belief. Certainly, my Government is of the view that land ownership and home ownership are effective means of economic empowerment; it is one of the best sources of financial security and independence for most people.
Not only is a home likely to be the largest purchase most people make in a lifetime, it is also likely to be the most important asset most people will ever own.
The work that real estate agents and brokers do is very important; it is not to be taken lightly. The advice and guidance that you provide to your clients is meant to assist them in making informed and, hopefully, correct decisions; for example, not to over-extend themselves financially and risk losing it all.
Doubtless you have an interest and a duty to safeguard the interests of both sellers and buyers of real property and to protect the reputation of honest realtors against unethical and unprincipled fraudsters.
Land development is good business in The Bahamas. Bahamian real estate has long been, and continues to be, highly sought after in both the domestic and international markets.
A vibrant real estate sector is crucial to a healthy and vibrant construction sector; both are important indicators of a healthy and growing economy.
Many of you will have lived through the ups and downs of the real estate market and remember periods of time when nothing seemed to move -- whether at the top, the bottom or the middle of the market. Fortunately, the extremes recently experienced in North America, have not been typical in our country where property and home prices are relatively more stable, though high.
It is with the recognition of this fact that the Government has worked with those in the business of real estate to strengthen the industry. Notwithstanding complaints from time to time, I believe that we have long banished the cumbersome and costly practices associated with the dreaded Immovable Property Act.
This has been especially important for the luxury real estate market which has thrived particularly since the enactment of the International Persons Landholding Act in 1993. At the same time we discontinued the discriminatory practice that required international persons acquiring land in The Bahamas to pay a higher rate of Stamp Duty than that paid by Bahamian citizens.
Last year we again took action meant to support the expansion of home-ownership, and hence of your industry, when we amended the Real Property Tax Act and the Stamp Act to exempt first time home-owners from the payment of stamp tax on the acquisition of a residence with a combined value (purchase and mortgage) of up to $500,000. This exemption applies to both purchaser and vendor and has a potential savings of $50,000.
Since last July 641 first-time home-owners have enjoyed this saving in connection with the acquisition of residences with a total value of $57 million. The Government gave up some $2.3 million in stamp tax revenues on those transactions. Additionally, some $814,000 was waived by the Government on mortgages totalling $86 million in connection with the purchase of first homes.
The amended Acts also exempted first-time home-owners from the payment of real property tax for the first five years of home-ownership.
We are taking additional action this year to further reduce the cost of home-ownership, reduce real property tax rates and extend the $250,000 owner-occupied exemption across the board to all home-owners, Bahamian and foreign, regardless of the period of occupancy in the residence by the owner.
My Government would like to have a low residential real property tax regime.
We believe that we ought to have a low real property tax residential rate. And, we believe it is possible to do this if, in fact, people declared the real value of their homes and paid the taxes due thereon.
I am aware that a new hew and cry has come from your sector associated with the removal by my Government last year of a four- year concession which capped real property tax payable on residential real property at $35,000 per annum.
You would be aware that it is an open secret in our society that most persons in The Bahamas pay real property taxes based on a value of their homes which is much less than the market value.
Indeed, some luxury homes bought 30 years ago, substantially renovated and even expanded, have on many occasions continued to pay on the value established at the time of original purchase or construction. I must say that this is also true of many other owner-occupied homes.
In many cases it is only the more recent sale of such properties at sums that dwarf the original purchase price which has brought the serious under-valuation of real properties in The Bahamas forcefully to the attention of the Chief Valuation Officer.
Some home-owners today, pay real property tax on the basis of the value of the vacant land upon which they have built premises but failed to register the construction and its value with the Valuation Department. Still others have never registered their property for real property tax purposes at all.
Such persons usually give by way of explanation that they have never received a bill from the Valuation Department notwithstanding that the Real Property Tax Act requires that a property owner declare and register his/her property for tax purposes.
In some cases such tax delinquents seek to poison the air when they are discovered by the Valuation Department and assessed their proper real property taxes. They some declare outrage at the dramatic increase in their tax bill! It is as true today as tomorrow or at any time – honesty is the best policy.
Ladies and Gentlemen:
The Bahamas offers an unbeatable combination of good weather, pristine beaches, excellent leisure time activity and, in general, available land – particularly outside New Providence.
Notwithstanding the dire conditions prevailing in the global economy and the consequential serious downturn in our own economy, international interests in Bahamian real property remains high.
I have found the noise in the market surrounding the imposition and removal of the residential real property tax cap interesting. I thought you might find the record of real property tax payments for that category of property owner of interest.
Prior to 2003 and the introduction of the cap, 17 owner-occupied properties paid annual real property taxes in excess of $35,000 in the amount of $1.1 million.
During the four-year period 2003-07 when the cap was in place, 57 such properties paid taxes of $35,000 per annum in the amount of $2 million.
Since the removal of the cap in July, 2007, 68 such properties have paid taxes in excess of $35,000 per annum in the amount of $4.1 million.
Can it be that we should design a special tax rate to accommodate 57 or 68 home-owners among the thousands of home-owners in the country; and to accommodate only the wealthiest home-owners?
Still, it is in the interest of all of us that we increase the compliance of home-owners in the payment of real property taxes owed across the board. And so I welcome your suggestions and offer some for your consideration.
We believe that, as opposed to the use of caps at the upper end of the real estate tax bracket and or revaluation by the Chief Valuation Officer, it would be infinitely fairer if we were to zone The Bahamas for real property tax purposes, determining property value for real property tax purposes on the basis of the square footage of improvements plus the value of the land, for example. Then we would not have to rely on sale prices to determine the value of real estate for real property tax purposes.
We must be able to agree that a 3,000-square-foot residence in Cooper’s Town, Abaco, would not have the same value as a residence of the same size in Lyford Cay in New Providence. A similar analogy might be made with regard to the value of land at Ocean Club Estates on Paradise Island, for example, versus similarly-sized property in Winton or in the Grove, West Bay Street.
We might also consider that the real property tax value will be calculated on say, 75% of a residence’s sale price. Either or all of these suggestions could provide certainty and stability as to tax liabilities for purchasers of real property in our country.
And, we may also set out the circumstances or conditions which will trigger or result in an increase in the value of properties in an orderly fashion so that tax increases are not unexpected or dramatic in nature.
Or, we might agree that foreign second-home-owners might be permitted to retain a residential designation for real property tax purposes even when their residences are not occupied by the owner for a minimum of nine months of the year, notwithstanding its use for short-term rentals to visitors. For such a concession we might require that such residences become subject to the payment of an occupancy tax when occupied by persons other than their owners or members of their immediate family in line with the occupancy room tax paid by hotels.
I believe that many things can be accomplished to the mutual benefit of the Government and its interest in safeguarding its revenue base, and yourselves with an interest in growing your clientele. But you must talk with us, and not at us, if we are to accomplish what we all seek – better for more Bahamians.
Ladies and Gentlemen:
As we do our part to support your industry and to develop and implement new efficient processes, I call upon your industry to play its part.
I take this opportunity to advise that my Government is proceeding with the preparation of a new Town Planning Act which we expect to post on the Ministry of Environment website next month so as to garner the views and recommendations of the general public. We solicit and welcome your input and comment on the draft legislation.
I particularly draw your attention to provisions concerning development of new subdivisions, developments on and near wetlands or along our coastline; provisions regulating construction setbacks from the high water mark or sand dune as might be appropriate. I suggest that you discuss the draft legislation amongst yourselves and with your clients. All comments received prior to mid-September will be considered.
Ladies and Gentlemen:
Alongside my Government’s commitment to the economic development of our country and its responsibility to protect the public revenue is a determination to ensure that such development is a part of a larger national planning process which secures other key national goals such as environmental sustainability and the preservation of our rich Bahamian culture.
Unchecked development, resulting in the destruction of both our natural and built heritage is also bad for business and the long-term viability of The Bahamas because it is that heritage which makes our country a destination for visitors from around the world, including second-home owners.
More importantly, policies welcoming foreign investment and long-term residents are but part of a broader land policy which must also safeguard access to our coastline, sea and beaches for Bahamians and further safeguard access to affordable land for generations of Bahamians for residential and commercial purposes thereby ensuring the protection of that “most sacred of all rights of citizenship”.
We could no more sell the buildings which house our Parliament or Supreme Court or dispose of Clifford Park than we can sell off endless amounts of land to non-Bahamians, forever alienating the natural patrimony which is integral to who we are as a people, integral to our sense of place and identity, integral to our future as a sovereign nation.
I firmly believe that it is the responsibility of the Government to integrate the economic and social aspects of national development, never losing sight of long-term goals in pursuit of short-term interests.
This is what has guided my previous and present administrations as we doubled the size of the national park system, and it will guide my Government’s land use policies to ensure that Bahamians have access to their land in order to pursue their dreams and ambitions and those of their children and grandchildren.
Again, congratulations on this very important anniversary. I extend very best wishes for the continued success of your industry and hence of our Bahamas.

Many of you will have lived through the ups and downs of the real estate market and remember periods of time when nothing seemed to move -- whether at the top, the bottom or the middle of the market. Fortunately, the extremes recently experienced in North America, have not been typical in our country where property and home prices are relatively more stable, though high.
It is with the recognition of this fact that the Government has worked with those in the business of real estate to strengthen the industry. Notwithstanding complaints from time to time, I believe that we have long banished the cumbersome and costly practices associated with the dreaded Immovable Property Act.
This has been especially important for the luxury real estate market which has thrived particularly since the enactment of the International Persons Landholding Act in 1993. At the same time we discontinued the discriminatory practice that required international persons acquiring land in The Bahamas to pay a higher rate of Stamp Duty than that paid by Bahamian citizens.
Last year we again took action meant to support the expansion of home-ownership, and hence of your industry, when we amended the Real Property Tax Act and the Stamp Act to exempt first time home-owners from the payment of stamp tax on the acquisition of a residence with a combined value (purchase and mortgage) of up to $500,000. This exemption applies to both purchaser and vendor and has a potential savings of $50,000.
Since last July 641 first-time home-owners have enjoyed this saving in connection with the acquisition of residences with a total value of $57 million. The Government gave up some $2.3 million in stamp tax revenues on those transactions. Additionally, some $814,000 was waived by the Government on mortgages totalling $86 million in connection with the purchase of first homes.
The amended Acts also exempted first-time home-owners from the payment of real property tax for the first five years of home-ownership.
We are taking additional action this year to further reduce the cost of home-ownership, reduce real property tax rates and extend the $250,000 owner-occupied exemption across the board to all home-owners, Bahamian and foreign, regardless of the period of occupancy in the residence by the owner.
My Government would like to have a low residential real property tax regime.
We believe that we ought to have a low real property tax residential rate. And, we believe it is possible to do this if, in fact, people declared the real value of their homes and paid the taxes due thereon.
I am aware that a new hew and cry has come from your sector associated with the removal by my Government last year of a four- year concession which capped real property tax payable on residential real property at $35,000 per annum.
You would be aware that it is an open secret in our society that most persons in The Bahamas pay real property taxes based on a value of their homes which is much less than the market value.
Indeed, some luxury homes bought 30 years ago, substantially renovated and even expanded, have on many occasions continued to pay on the value established at the time of original purchase or construction. I must say that this is also true of many other owner-occupied homes.
In many cases it is only the more recent sale of such properties at sums that dwarf the original purchase price which has brought the serious under-valuation of real properties in The Bahamas forcefully to the attention of the Chief Valuation Officer.
Some home-owners today, pay real property tax on the basis of the value of the vacant land upon which they have built premises but failed to register the construction and its value with the Valuation Department. Still others have never registered their property for real property tax purposes at all.
Such persons usually give by way of explanation that they have never received a bill from the Valuation Department notwithstanding that the Real Property Tax Act requires that a property owner declare and register his/her property for tax purposes.
In some cases such tax delinquents seek to poison the air when they are discovered by the Valuation Department and assessed their proper real property taxes. They some declare outrage at the dramatic increase in their tax bill! It is as true today as tomorrow or at any time – honesty is the best policy.
Ladies and Gentlemen:
The Bahamas offers an unbeatable combination of good weather, pristine beaches, excellent leisure time activity and, in general, available land – particularly outside New Providence.
Notwithstanding the dire conditions prevailing in the global economy and the consequential serious downturn in our own economy, international interests in Bahamian real property remains high.
I have found the noise in the market surrounding the imposition and removal of the residential real property tax cap interesting. I thought you might find the record of real property tax payments for that category of property owner of interest.
Prior to 2003 and the introduction of the cap, 17 owner-occupied properties paid annual real property taxes in excess of $35,000 in the amount of $1.1 million.
During the four-year period 2003-07 when the cap was in place, 57 such properties paid taxes of $35,000 per annum in the amount of $2 million.
Since the removal of the cap in July, 2007, 68 such properties have paid taxes in excess of $35,000 per annum in the amount of $4.1 million.
Can it be that we should design a special tax rate to accommodate 57 or 68 home-owners among the thousands of home-owners in the country; and to accommodate only the wealthiest home-owners?
Still, it is in the interest of all of us that we increase the compliance of home-owners in the payment of real property taxes owed across the board. And so I welcome your suggestions and offer some for your consideration.
We believe that, as opposed to the use of caps at the upper end of the real estate tax bracket and or revaluation by the Chief Valuation Officer, it would be infinitely fairer if we were to zone The Bahamas for real property tax purposes, determining property value for real property tax purposes on the basis of the square footage of improvements plus the value of the land, for example. Then we would not have to rely on sale prices to determine the value of real estate for real property tax purposes.
We must be able to agree that a 3,000-square-foot residence in Cooper’s Town, Abaco, would not have the same value as a residence of the same size in Lyford Cay in New Providence. A similar analogy might be made with regard to the value of land at Ocean Club Estates on Paradise Island, for example, versus similarly-sized property in Winton or in the Grove, West Bay Street.
We might also consider that the real property tax value will be calculated on say, 75% of a residence’s sale price. Either or all of these suggestions could provide certainty and stability as to tax liabilities for purchasers of real property in our country.
And, we may also set out the circumstances or conditions which will trigger or result in an increase in the value of properties in an orderly fashion so that tax increases are not unexpected or dramatic in nature.
Or, we might agree that foreign second-home-owners might be permitted to retain a residential designation for real property tax purposes even when their residences are not occupied by the owner for a minimum of nine months of the year, notwithstanding its use for short-term rentals to visitors. For such a concession we might require that such residences become subject to the payment of an occupancy tax when occupied by persons other than their owners or members of their immediate family in line with the occupancy room tax paid by hotels.
I believe that many things can be accomplished to the mutual benefit of the Government and its interest in safeguarding its revenue base, and yourselves with an interest in growing your clientele. But you must talk with us, and not at us, if we are to accomplish what we all seek – better for more Bahamians.
Ladies and Gentlemen:
As we do our part to support your industry and to develop and implement new efficient processes, I call upon your industry to play its part.
I take this opportunity to advise that my Government is proceeding with the preparation of a new Town Planning Act which we expect to post on the Ministry of Environment website next month so as to garner the views and recommendations of the general public. We solicit and welcome your input and comment on the draft legislation.
I particularly draw your attention to provisions concerning development of new subdivisions, developments on and near wetlands or along our coastline; provisions regulating construction setbacks from the high water mark or sand dune as might be appropriate. I suggest that you discuss the draft legislation amongst yourselves and with your clients. All comments received prior to mid-September will be considered.
Ladies and Gentlemen:
Alongside my Government’s commitment to the economic development of our country and its responsibility to protect the public revenue is a determination to ensure that such development is a part of a larger national planning process which secures other key national goals such as environmental sustainability and the preservation of our rich Bahamian culture.
Unchecked development, resulting in the destruction of both our natural and built heritage is also bad for business and the long-term viability of The Bahamas because it is that heritage which makes our country a destination for visitors from around the world, including second-home owners.
More importantly, policies welcoming foreign investment and long-term residents are but part of a broader land policy which must also safeguard access to our coastline, sea and beaches for Bahamians and further safeguard access to affordable land for generations of Bahamians for residential and commercial purposes thereby ensuring the protection of that “most sacred of all rights of citizenship”.
We could no more sell the buildings which house our Parliament or Supreme Court or dispose of Clifford Park than we can sell off endless amounts of land to non-Bahamians, forever alienating the natural patrimony which is integral to who we are as a people, integral to our sense of place and identity, integral to our future as a sovereign nation.
I firmly believe that it is the responsibility of the Government to integrate the economic and social aspects of national development, never losing sight of long-term goals in pursuit of short-term interests.
This is what has guided my previous and present administrations as we doubled the size of the national park system, and it will guide my Government’s land use policies to ensure that Bahamians have access to their land in order to pursue their dreams and ambitions and those of their children and grandchildren.
Again, congratulations on this very important anniversary. I extend very best wishes for the continued success of your industry and hence of our Bahamas.

So is anything selling? Have things picked up?
Well folks these are the two questions I was asked yesterday. My answer- I replied that the market is still soft, yes, however the houses and vacant properties that I have sold within the past 6 months or so sold because they were priced right--Priced realistically. The sellers of these properties were serious about selling and listened to my advice on pricing their property.
In a buyers market a listing must be priced to sell. I've said this many times before and those sellers that heeded that advice reaped the benefits.
Sellers, listen to your real estate agent. They are able to compile a list of comparable properties and effectively price your home so that you maximize your dollar while making it attractive to a buyer.
As many of you know, our Bahamas MLS has been established now for over a year. We are very quickly building a database that is making it much easier to gather comps. Sellers, if you are interviewing an agent ask them if they are a member of the Bahamas MLS. Dolphin (Mahi Mahi) fishing
Yes folks it's that time again. The dolphin are running in schools.The Man-O-War Marina held their annual tournament and once again the much anticipated event brought people to our shores for a visit so they could participate. The locals look forward to this event also. A few of the men AND even a lady take a few days off of work to compete to see who can reel in the biggest dolphin. This year the weather didn't cooperate so well. It was quite windy and the wave action was a hot topic.
On the final night the Marina hosted an awards dinner at the Dock N Dine restaurant and presented numerous awards. The food was fabulous and included peas n rice, macaroni and cheese, green beans, grilled baby back ribs, fried fish, and prime rib. I worked on the evening of the awards and I must say it looked as if everyone was having a fantastic time!
I was especially happy to see that a past customer of mine who I had sold a home to on Man-O-War had flown in for the special occasion and brought a couple of friends with him. It is so nice to see our second home owners enjoying our island and participating in local events.
The weather the past few days have actually been much nicer and a lot more people are out there casting their rods and reeling them in. I think that many people will be enjoying a few meals of grilled Mahi Mahi over the next few months.

Happy Easter
Happy Easter to all!
Every Easter Sunday morning the community gathers at the beach on the cemetery road in Man-O-War for a sunrise service where we all remember that this is the day Christ rose from the grave. All are welcome and there usually is a nice turn out of natives, second home owners and even tourist. Afterward there is a lovely breakfast at the fellowship hall of the Church of God for all to enjoy. The ladies of the island each bring a dish, whether it is a bowl of danishes or muffins, fruit or the famous johnny cake but there is always enough for everyone. The service will start at 6:30am. All are welcome.

On the Bright Side
Hello Everyone,
Well you all know how slow it's been here in Abaco, not only in the real estate business but it seems everyone was feeling the pinch. On the bright side of things, as many of you are aware, I work some evening at the Dock N Dine restaurant in Man-O-War. A lovely restaurant set out on the deck and overlooks the Man-O-War Marina, and Man-O-War's harbour. I must say that we have been busy! They have been very busy during the day for lunch and we have also been quite busy in the evenings. There are quite a number of tourist and boasters around as well as second home owners. This is great as it shows that there are still people out there and traveling around and spending money. I'm thinking, wow, if this is the slow time I wonder how busy we'll be when things pick up! If you are in Abaco stop by for lunch or dinner. The Dock N. Dine has wonderful food and if it is the evening when you stop by I just might see you there.
Also this weekend is the 12th Annual Boat Harbour Art Show. This is hosted at the Pavilion and it gives you the opportunity to view arts and crafts created by our very talented locals. It is a much anticipated event and I wish them much success this weekend.
A reminder as well that next weekend is Sojer Day in Man-O-War Cay. This is our first annual heritage day event and we look forward to seeing you there. Catch a ferry over to a day of fun and history.

The Horticulturist Society
Hi Folks,
Well sometimes it goes weeks and I don't submit a blog and today I have three! Oh well, I guess that means I have been busy.
I joined the Horticulturist Society on Saturday and am so glad I did! This month's meeting was focused on Orchids. We had a guest speaker from Nassau who has been growing orchids for about 20 years. He did a demonstration on separating and re potting.
Members bring a potted plan to the meeting and at the end of the meeting the plants are auctioned off to other members. The Orchids that our guest speaker brought over were auctioned off as well. I walked away with a gorgeous and unique bromeliad that a member brought and also an orchid.
I will enjoy being a member of this society. It gives me a chance to meet and mingle with locals as well as people who have purchased real estate here in Abaco. Together we are making our yards beautiful!

Report on the MOW Flea Market
Well the Flea Market was Saturday past, and it turned out to be quiet a success for the Man-O-War All Age School as usual. I did show real estate on Saturday so I missed most of it, but all of my reports were the same. People enjoyed a variety of food, and games, and there were some fantastic items from 'The Pantry'. 'The Pantry' always has a table that is just filled with homemade jellies, jams, cheese spreads, delicious cakes and cheeses and so much more. There were quiet a few art tables and jewelery tables as well as the peopel who were just selling used items.
I heard that the ferries may have brought over as many as 500 people, and that's besides the sail boaters, and people who showed up from the surrounding Cays on their private boats. I would venture to say that this is one of the biggest annual events in Abaco. If you've never been, please plan to come and attend next year!

Developement at Schooner Bay
Last week Wednesday members of the Coldwell Banker Team toured Schooner Bay, and what a lovely day it was.
We toured by bus, and stopped and walked around at a few special locations. We all were excited about this development as it will be a community. Not an exclusive resort, but a place that will have shops restaurants, offices, and more, and all open to the general public. There is even a reserved location that is designated for a school.
I am happy that they are an eco-friendly development and are going to great lengths to remove the invasive plants that are on the property and replace them with plants that are friendly to our environment and will help hold the beach dunes in place, and prevent erosion.
They also have a large number of acres leased from government that will be available to property owners to farm on. This is an awesome feature in my opinion.

MOW Annual Flea Market
It's that time of the year again! That's right the annual flea market held by the Man-O-War All Age School. This is always held near the MOW Marina property. Locals from all over Abaco and visitors a like look forward to this event every year. People start asking from December if I know what date the Flea market is set for next year? lol. This event generally draws several hundred people.
There are lots of tables set up with people selling off items... art, dinners, conch salad, fruit preserves, desserts, items that they just don't need anymore. Remember one man's junk is another man's treasure. Of course there are games for the kids such as take a chance, raffle, and even sojer crab races most of time!
This is the big fund raiser for the Man-O-War All Age School. It seems that for the last 7 - 8 years I've missed the majority of the event as I always have to show property that Saturday, but I do my part and have someone pick up a few items for me and buy a few raffle tickets.
If you're in Abaco, please come on out and support the school. You can catch the 10:30am ferry from Marsh Harbour to Man-O-War and there are ferries going back to Marsh Harbour through out the day.

Man-O-War Hertitage Day- called Sojer Day!
Man-O-War Cay is having its first Heritage day on April 4th. We are calling this event Sojer Day, since Man-O-War people are nick named 'Sojers'.
We will have items from our grandparents and great grandparents era on display in several of the old homes that are still around. There will be food, arts and crafts, games, old pictures, and more.
I am on the committee and I can tell you that the team that is working on putting this day together is very enthused and committed to making this day a big success.

a snap of cold
Well the temp dropped last night and is now 59ยบ...brrrr...so the snow birds would laugh at me right? But when we add in the wet cold wind that we have with it, it sure can seem a lot colder. These cold fronts don't last long. Usually a day or two and then it's over, the warm sun is beating down again and people are back out in the boat and enjoying the outdoors.

The Positives
Sometimes we find ourselves dwelling on the negatives when there are a lot of positives that we should be focusing on. The media plays a big roll in that I'm sure, and most of the time all we hear is doom and gloom.
I want to point out a few positives today.
First of all there have been a lot of tourist around over the holidays. This tells me that even though some may have had their trips booked before the worst of the economic times struck they are still in a position to travel and spend a bit of money. I've noticed Americans, Canadians, and Europeans.
Second, gas prices did fall in the US as well as here and even though that may sound like a negative thing, in a big way this is good for the everyday consumer.
Thirdly, in an article in Real Estate Outlook: What's in store for 2009? by Kenneth Harney, Realty Times, Jan. 6, 2009, he mentions that Americans are actually saving again, the national savings rate took a nearly 3% jump last month. That might sound small, but it's hugely important if it is the start of a trend.
So there are positives out there, especially for those who may be or soon will be in position to buy. Take advantage now during the buyer's market!

BREA Abaco Board
Happy New Year to all.
Well 2009 is here and I am optimistic that the economy will pick up. I was pleasantly surprised to see so many tourist here in Abaco over the Christmas and New Years holiday. Hopefully that within itself is a sign that people will be traveling this year.
As many of you know I was elected once again as a Director on the Bahamas Real Estate Association board (Abaco Chapter) in December 08. We, as a board held our first meeting yesterday. I feel that we have a very strong board that will endeavor to represent the Abaco agents very well. I am responsible for BREA Abaco's Public Relations. We are striving to educate people that we do in fact have a board and are taking it upon ourselves to make the public aware that when purchasing real estate please make sure that your agent is in fact a BREA licensed agent. This will be one of the task that I will be undertaking. What better way to begin than posting it on a blog!
I hope 2009 bring you all lots of health and happiness and should you decide to look for that special place in Abaco as a second home, I am here to help.
